What is allowed?

Renting a dumpster for medium to large home clean-outs and other projects is an excellent idea. We are very flexible about where we set our dumpsters, however, we still must comply with city, county and state laws. If the driveway is large enough we can almost always place a dumpster on private driveways, and parking areas. Some cities or counties will allow dumpsters to be placed on a curb or in city streets either with or without a permit, however, there are some that do not allow dumpsters to be placed anywhere besides private property.

What is not allowed? 

The City of Bremen does not allow dumpsters to be placed on any public property such as the street, or sidewalk. They do this in order to promote safety for all their residents of Bremen City. If a dumpster were placed on street, it could block the vision of drivers and cause harm to others. Even though Bremen City only permits dumpsters on private property there are benefits. A benefit to putting a dumpster on private property versus the street is it will decrease the amount of unlawful dumping. Although unlawful dumping may not seem like an issue it can quickly become an one to you, the person who rented the dumpster because if there are restricted items put in the dumpster the renter could be charged additional fees and may be forced to dispose of the item(s) separately.

(a)
No person shall place or cause to be placed in any street and sidewalk: debris, rubbish, irrigation water, boxes, displays, signs, poles, goods, merchandise, or any other object so as to impede and endanger traffic on streets and sidewalks.
(b)
No person or company shall construct or maintain a drive, yard, or lot constructed of gravel, pebbles, or stone in such a manner that vehicles cause loose stones, pebbles or gravel to be thrown on to the adjacent street and sidewalk.
(c)
Any personal property placed on the right-of-way following an eviction shall be removed within 24 hours of physical eviction, unless an extension of time is requested on behalf of the evicted tenant. For purposes of this chapter such property is deemed abandoned property, unless the landlord by contract specifies a shorter time. If the property is not removed within 24 hours, the city may commence removal and cite the property owner. The penalty assessed shall be 125 percent of the cost the city incurs in removing the property.

Coweta County does not allow dumpsters to be placed on any public property such as the street, or sidewalk. They do this in order to promote safety for all their residents of Coweta County. If a dumpster were placed on street, it could block the vision of drivers and cause harm to others. Even though Coweta County only permits dumpsters on private property there are benefits. A benefit to putting a dumpster on private property versus the street is it will decrease the amount of unlawful dumping. Although unlawful dumping may not seem like an issue it can quickly become an one to you, the person who rented the dumpster because if there are restricted items put in the dumpster the renter could be charged additional fees and may be forced to dispose of the item(s) separately.

It shall be unlawful for any person to obstruct, encroach upon, or injure materially any part of any county road or county rights-of-way. For purposes of this section, the term "obstruct" shall include, without limitation, the causing of any buildup of rock, gravel, mud, dirt, chemicals, or other materials by continued ingress and egress of vehicles or of any natural waters dammed or redirected by diversion to an extent which presents a hazard to the traveling public.
In addition to the penalties and fines provided for in chapter 1, section 1-15, any person who unlawfully obstructs, encroaches upon, or injures said public road may be required to pay restitution to the county for the costs of removal of said obstructions or encroachments and the costs of repairs of the public road incurred by the county, including any costs associated with traffic management provided, however, that such costs shall be limited to those costs which are directly incurred from such damages. Costs incurred for traffic management may include, but not be limited to, costs incurred for flagging, signing, or provision of detours, provided that these activities are directly caused by the obstruction, encroachment, or injury to the county road or right-of-way.

Fayette County does not have restrictions limiting residents to only be allowed to place a dumpster in their driveway. Fayette County will allow a temporary rental dumpster to be placed in the street as long as the person who is renting the dumpster applies and receives a permit or written consent. The county wants to be sure they do everything they can to help its citizens by helping to keep everyone safe. Also, as a suggestion, it is always a good idea to look at the HOA for the neighborhood you live in to see if they have restrictions for items in the street and/or the driveway.

The location of private utilities upon the public right-of-way shall be permitted, subject to the following conditions:
(1)
No private utility locations upon the public right-of-way shall be allowed unless the proposed utility location is within a residential subdivision, as defined by appendix IV of this Code, and that said subdivision is governed by a Property Owners Association (POA) as defined under OCGA § 44-3-220 et seq.
(2)
No private utility locations upon the public right-of-way shall be permitted, unless a license is granted, by the board of commissioners. As a condition of such license, the applicant must agree in writing to hold the Board of Commissioners of Spalding County harmless for any damages and/or liability resulting from the presence of said private utility upon the public right-of-way.
(3)
The granting of a license shall not convey any property interest in the county's right-of-way whatsoever.
(4)
The county may withdraw the license at will and upon doing so, the private utility will be removed in no more than thirty (30) days.
All provisions of the Code in conflict with this section are hereby repealed

  • Any person who shall violate the terms of this article, or who shall excavate or cut any public road in the 
  • county without first obtaining a permit therefor, may be subject to punishment in accordance
  • (a)
    Any person shall obtain a permit prior to the installation, construction, maintenance, renewal,
     removal and relocation of pipes, mains, conduits, cables, wires, poles, towers, drains or
     appliances of any utility in, on, along, over or under the public roads of the county.
    (b)
    Application for the permit required by this section shall be made in writing to the director of
    transportation and development. Such application shall specifically describe the nature, extent
    and location of the portion of the public roads affected. As a condition precedent to the granting of
    a permit, the county engineer may require the applicant to furnish an indemnity bond or other
     acceptable security conditioned to pay any damages to any part of the county road system or to
     any member of the public caused by work of the applicant under authority of such per
    mit.
