What is allowed?

Renting a dumpster for medium to large home clean-outs and other projects is an excellent idea. We are very flexible about where we set our dumpsters, however, we still must comply with city, county and state laws. If the driveway is large enough we can almost always place a dumpster on private driveways, and parking areas. What is not allowed? 

DeKalb County does not allow dumpsters to be placed on any public property such as the street, or sidewalk. They do this in order to promote safety for all their residents of DeKalb County. If a dumpster were placed on street, it could block the vision of drivers and cause harm to others. Even though DeKalb County only permits dumpsters on private property there are benefits. A benefit to putting a dumpster on private property versus the street is it will decrease the amount of unlawful dumping. Although unlawful dumping may not seem like an issue it can quickly become an one to you, the person who rented the dumpster because if there are restricted items put in the dumpster the renter could be charged additional fees and may be forced to dispose of the item(s) separately.

Sec. 17-6. - Obstructions to right-of-way.

(a)

Prohibited. It shall be unlawful for any person to obstruct the right-of-way of any public road, street or other easement in the unincorporated area of the county by placing or maintaining thereon any obstruction, whether it is in the nature of shrubbery, signs, fences or whatever, which interferes with the clear view of motorists or the free passage of pedestrians thereon.

(b)

Notice to remove. Wherever any obstruction prohibited by subsection (a) has been placed and is being maintained, the police department shall notify in writing the owner of the obstruction and the owner of the land abutting the right-of-way where the obstruction is found and also the person in possession of the property. Such notice shall state the nature of the obstruction and the fact that the obstruction is an interference with the clear view of motorists or the free passage of pedestrians and that it shall be removed within ten (10) days from the date of the notice.

(c)

Issuance of summons upon failure to remove. Whenever the person so notified as provided by subsection (b) of this section fails or refuses to remove the obstruction within the time allowed in the written notice, the police department shall issue a summons to this person to appear in recorder's court on a day certain to stand trial for the violation.

(d)

Continued violations; issuance of summons without notice. If upon conviction for the first offense the person continues to refuse to remove the obstruction, each day that it remains intact shall constitute a new violation of subsection (a) of this section for which the police department shall issue a summons, without first issuing the written notice.

The county wants to be sure they do everything they can to help its citizens by helping to keep everyone safe. Also, as a suggestion, it is always a good idea to look at the HOA for the neighborhood you live in to see if they have restrictions for items in the street and/or the driveway.

Sec. 62-87. - Permits required for installation or excavation in rights-of-way and roads; no property interest in location of utility facility.

Before installing or relocating any utility facility which may occupy or encroach on the right-of-way acquired for county projects, or which is part of the county road system, the utility owner and/or contractor must obtain authorization from the county department of public works. For all initial installation a written permit will be executed. Also, for relocation or adjustment of utility facilities for which a written permit has not previously been issued, and which are not covered by an indemnity agreement, a permit will be executed. Except as may be provided by state or federal laws, placement of a utility facility within the public rights-of-way or public roads shall not be deemed to give any person a property or other interest in any particular location within the public rights-of-way or public roads, or any preference over any other person issued a permit to utilize the public rights-of-way or public roads. The county reserves the right to designate where a particular utility facility may be located for the purposes of protecting current or future use of its public roads to promote the public health, safety or welfare.

Sec. 14-40. - Notice of intention to utilize right-of - way.

Any public utility or communications services provider (CSP) seeking to access, condemn or utilize an easement or right of use or access over or through or within the paved or unpaved portion of the public right-of-way which is under the supervision and control of the county, in order to run wires, pipes, cables, maintain dams, flow backwater, establish facilities, or for any other uses necessary to its purpose, shall first notify the county transportation department or its designated agent of the utility's or CSP's intention to so access, condemn or utilize, and all cases other than condemnation said utility or CSP must obtain a permit from the transportation department. Utilization shall mean any manner of use of the above-described right-of-way, including but not limited to, cutting of the pavement or boring under the pavement or cutting or boring of the ground outside of the paved area. Such notification must include the location and description of the right-of-way to be accessed, condemned or utilized and the purpose of the access, condemnation or utilization. In the event of emergency repair service involving utilization of the paved portion of the right-of-way during hours other than normal office hours, the utility or CSP shall notify the transportation department on the next business day.

A minimum of a 60-foot dedicated right-of-way will be required. A 50-foot right-of-way shall be permitted if curbed and guttered.

Any person seeking permission to construct, operate and/or maintain any utility within the public right-of-way of any county road of the county shall apply for a permit to the department of roads and bridges, upon an application form provided by such department.

Sec. 22-102. - Protection of traffic and roadway.

Unless specifically in the permit, no utility may occupy the city rights-of-way unless sufficient space is available so that the free flow and safety of traffic and other capacity considerations are not unduly impaired and the installation does not prevent the department from reasonably maintaining the streets, structures, traffic control devices and other appurtenant facilities, and further provided that maintenance and operations of the facilities do not jeopardize the traffic, street structure, other users of the right-of-way or the right-of-way itself.
