What is allowed?

Renting a dumpster for medium to large home clean-outs and other projects is an excellent idea. We are very flexible about where we set our dumpsters, however, we still must comply with city, county and state laws. City of Locust Grove will allow a temporary rental dumpster to be placed in the street as long as the person who is renting the dumpster applies and receives a permit or written consent. The city wants to be sure they do everything they can to help its citizens by helping to keep everyone safe. Also, as a suggestion, it is always a good idea to look at the HOA for the neighborhood you live in to see if they have restrictions for items in the street and/or the driveway.

A.
Use of public streets, alleyways, sidewalks, and roads of the city which blocks or impedes vehicular, bicycle, and/or pedestrian movement within the public right-of-way for extended periods of time shall not be permitted; unless permission has been granted by the mayor and city council as part of a special events permit.
B.
The placement of an object which blocks or impedes vehicular, bicycle, and/or pedestrian movement within the public right-of-way for extended periods of time in any portion of a public street, alleyway, sidewalk or road of the city shall be prohibited unless the mayor and city council specifically approve the use of such object as part of a special events permit.
C.
For use in this section, the phrase "block or impede" means to occupy the public right-of-way used for vehicular, bicycle, and/or pedestrian movement in such a manner as to endanger the safety of the traveling public or result in damage to personal or real property of another person or entity.
D.
For use in this section, the phrase "extended periods of time" means more than thirty consecutive minutes where not part of an official action of government or utility or emergency operation.
E.
For use in this section, the term "object" under this section includes but is not limited to recreational equipment such as basketball goals, skateboard or bicycle ramps, soccer and hockey goals, and the like.
F.
For use in this section, the term "special events permit" means an event or activity approval by the mayor and city council such as a street party, parade, cultural or arts festival, a sporting event, street fair or similar activity. Applications for special events permits shall be filed with the city clerk at least forty-five days prior to the date of the event, unless waived by the mayor and city council at an intervening meeting date.
G.
Notwithstanding this section or the grant of a special events permit, the mayor and council may identify and prohibit entirely any and all uses which block or impede vehicular, bicycle, and/or pedestrian movement within certain designated public rights-of-way (or portions thereof) of the city for any period of time.

Unless specifically in the Permit, no Utility may occupy the City rights-of-way unless sufficient space is available so that the free flow and safety of traffic and other capacity considerations are not unduly impaired and the installation does not prevent the Department from reasonably maintaining the streets, structures, traffic control devices and other appurtenant facilities, and further provided that maintenance and operations of the Facilities do not jeopardize the traffic, street structure, other users of the right-of-way or the right-of-way itself.

The city is vitally concerned with the use, construction within, and occupancy of all rights-of-way in the city as such rights-of-way are a valuable and limited resource which must be utilized to promote the public health, safety, welfare, economic development of the city and to protect public work infrastructure.   • (a)
    No person shall place or cause to be placed in any street and sidewalk: debris, rubbish, irrigation water, boxes, displays, signs, poles, goods, merchandise, or any other object so as to impede and endanger traffic on streets and sidewalks.
    (b)
    No person or company shall construct or maintain a drive, yard, or lot constructed of gravel, pebbles, or stone in such a manner that vehicles cause loose stones, pebbles or gravel to be thrown on to the adjacent street and sidewalk.
    (c)
    Any personal property placed on the right-of-way following an eviction shall be removed within 24 hours of physical eviction, unless an extension of time is requested on behalf of the evicted tenant. For purposes of this chapter such property is deemed abandoned property two hours following eviction, unless the landlord by contract specifies a shorter time. If the property is not removed within 24 hours, the city may commence removal and cite the property owner. The penalty assessed shall be 125 percent of the cost the city incurs in removing the property.
